Webinar - CMS's Heightened Scrutiny Review of Misericordia

In October 2022, CMS visited Misericordia to conduct a heightened scrutiny review to determine if Misericordia's campus-based day services setting complies with the home and community-based services (HCBS) settings criteria at 42 CFR § 441.301(c)(4).

The letter from CMS to the Illinois Medicaid agency regarding CMS’s heightened scrutiny site visit to certain settings in Illinois last fall shows that CMS has concluded that Misericordia’s Community Day Services program passed heightened scrutiny (see pages 6, 22 and 23 of the site visit report).

The report contains a summary chart of the regulatory criteria as well as a summary chart of the regulatory criteria and "Violation Finding Based on Site Visit" per each setting CMS visited in Illinois.
